Justice Kehinde Ogundare of the Federal High Court on Monday dismissed a N500 million copyright infringement suit filed against singer Kisii and her brother, billionaire businessman Emoney.
The presiding judge determined that the plaintiff, Jude Nam, had not submitted any reliable evidence to prove the alleged copyright infringement.
In his lawsuit, Nunamu claims that Kisii secretly recorded songs such as “Som Tu Chukwu,” “Otito Diri Chineke,” and “K’Anyi Gee N Uro Chukwu” without his consent. He claimed to have added it to the album.
The composer sought a written or oral declaration that the three defendants jointly infringed the copyright by producing and selling it without permission.
He also asked the defendants to pay all royalties for the songs and stop further infringement.
Nnam further sought damages of N500 million from the defendants and N5 million in legal costs.
However, KCee and E-Money denied all of the plaintiffs’ claims, calling Nnam’s claims “frivolous” and an attempt at extortion.
Apart from the dismissal of the case, Ogundere also ordered punitive costs of NOK 1 million against Namu.
The copyright infringement lawsuit has been ongoing since 2021.
